Following Cabinet Approval and Referral to the Shura Council: Legal Experts Tell Al Sharq

Legal experts confirmed to Al Sharq that amendments to several articles of the Civil and Commercial Procedures Law, issued under Decree Law No. 13 of 1990, are underway as part of efforts to modernize the electronic judicial system. The amendments aim to develop legislative and procedural frameworks, strengthen litigants’ rights and safeguards, and keep pace with digital transformation across the judiciary.

Lawyer Ahmed Mousa stated that the amendments facilitate the procedures used by litigants when reviewing cases, contributing to the creation of a more efficient path and updated judicial mechanisms for managing daily case files and legal memoranda before the courts, in relation to filing lawsuits, defenses, hearing procedures, and the issuance of rulings, judgments, and related matters.

Lawyer Mohsen Al Haddad said the draft amendment includes several updates aimed at developing procedural legislation and simplifying electronic litigation procedures within the sector, reinforcing efforts to advance the electronic litigation system in support of the country’s investment and business environment.

Lawyer Salah Al Jalahma commented that the amendment project reflects a clear direction toward digital transformation in judicial services, in a manner that keeps pace with contemporary developments and society’s evolving needs for growth and progress, while reinforcing the effectiveness and speed of judicial procedures.

Lawyer Fawzia Al Abaidli: Laws Keep Pace with New Developments and Are Anchored in Litigation Frameworks

Lawyer Fawzia Al Abaidli affirmed that the State attaches great importance to reviewing and developing legislation in line with community needs, noting that the current amendment falls within efforts to modernize the procedural framework governing litigation before the courts, in a manner that reflects the growing volume and complexity of cases and reinforces the guarantees available to litigants.

Procedural Flexibility

Lawyer Fawzia Al Abaidli added that the amendment introduces greater flexibility in litigation procedures and mechanisms, addressing the practical challenges litigants and legal practitioners commonly face, and works toward simplifying and speeding up the preparation of pleadings and the referral of cases to the relevant judicial authorities, while enhancing safeguards for defense rights and access to justice.

She noted that the draft amendment introduces several new provisions targeting the development of electronic litigation infrastructure, aiming to reduce case backlogs and expedite court procedures, in alignment with the directions of the State’s development strategy.

Consolidating Electronic Litigation

On this point, the draft amendment project includes several key articles and provisions related to updating the electronic case-filing and litigation system, focused on developing the judiciary’s electronic infrastructure and enhancing digital transformation across judicial services, so as to reduce reliance on paper-based procedures and support faster, more accurate access to case files and documentation.

The draft further aims to develop updated mechanisms consistent with best practices, harmonizing procedural rules with the requirements of electronic litigation while balancing speed with the preservation of due process rights, and unifying certain procedural pathways related to case management.

Facilitating Procedures for Applicants

On another note, lawyer Ahmed Mousa said that among the objectives of the amendment is enabling relevant judicial authorities to adopt more responsive procedural mechanisms, an approach he described as necessary given the growing volume of cases before the courts.
